High Court Forbids Any Action On KCR, Harish Rao

The Telangana High Court said the government could take no adverse action on the basis of the P C Ghose Commission report on the Kaleshwaram project.

The Telangana High Court today directed the State government not to take any adverse action on the basis of the P C Ghose Commission's report on the Kaleshwaram project.

A bench comprising Chief Justice Aparesh Kumar Singh and Justice G M Mohiuddin asked the Advocate General whether any action had been taken after the Commission's findings. The Advocate General informed the court that the government had decided to transfer the case to the CBI for investigation, based on the National Dam Safety Authority (NDSA) report and other evidence.

"No action has been taken so far on the Kaleshwaram Commission report. The CBI probe has been recommended based on the NDSA report. The CBI will conduct an independent investigation without relying on the Commission," he said.

Counsel for the petitioners K Chandrashekar Rao and T Harish Rao argued that the government order referred to the Commission's report and could allow the CBI to act on its findings.

Considering the State government's earlier undertaking and the pending case on the legality of the Commission's report, the court directed that no adverse action be taken until October 7, the next date of hearing.

The State government was directed to file its counter to both the main petition and the interim application seeking a stay on the report, by then.
