The Hyderabad High Court on Friday made it clear that there would be no division of the High Court till the construction of new building for the Andhra Pradesh High Court in the residuary state. Further, the building for the A P High Court could not be constructed in Telangana, it ruled.
Delivering its judgment on a petition pertaining to the bifurcation of the High Court, the court said that as per the Andhra Pradesh Reorganisation Act, 2014, the present HC building would belong to Telangana.
The court said that the responsibility of the construction of a new High Court building for AP lay with the Centre. Therefore, the central government should release funds for the purpose.
The court said that the existing premises would be utilized jointly by the Telangana and Andhra Pradesh governments, and, if required, separate benches could be established.
The court also ruled that the Telangana government was not empowered to establish a separate High Court at a land near Gachibowli or any other place for Telangana. (INN)
