A special CBI court on Tuesday dismissed a second bail petition by YSR Congress party president Y S Jaganmohan Reddy in the disproportionate assets case.
It may be mentioned that Jagan had earlier moved two petitions in the court seeking bail. While the first petition had been filed as a statutory right under Section 167 (2) Cr PC, the second regular petition was filed under Section 437 of the CrPC. The court had dismissed the statutory bail petition on November 28 while observing that granting bail at this stage of the pending investigation might affect the investigation, and infringe on the avowed purpose set out by the Supreme Court in its order.
After this, Jagan moved the Andhra Pradesh High Court on November 30 seeking bail, and the matter is scheduled for a hearing on December 11.
Earlier, the CBI had opposed a second bail petition contending that Jagan could approach the trial court for bail only after it completes its investigation in all the seven other cases lodged against him. The CBI's counsel told the court that, since it was a case was of economic offence, it might take some more time for the agency to complete the investigation. He said that the probe was staged and statements of several witnesses were yet to be recorded and hence bail should not be granted.
However, Jagan's counsel S Niranjan Reddy claimed that the CBI had committed to the Supreme Court that it would file the charge sheet at the earliest.
Jagan is presently lodged in Chanchalguda Central Prison since his arrest on May 27. (INN)
