Blow To TRS As SC Agrees With Defection Petition

In favour of the petition filed by the Congress, the SC transferred party defections case to its Constitutional Bench.
Hyderabad | 8th November 2016
In favour of the petition filed by Telangana Congress leaders against party defections, the Supreme Court today transferred the MLA disqualification petition to its Constitutional Bench.

The two-member Bench took up the hearing on Tuesday on the petition filed by Congress MLA S A Sampath Kumar from Telangana.

The apex court said that it agreed with the petitioner's arguments.

In a blow to the TRS, the Court said that it did not believe that the Telangana Assembly Speaker would take an impartial decision on the disqualification of the MLAs.

However it clarified that it did not hold the authority to order the Speaker, and asked the Five-Member Constitutional Bench take a decision on it instead, and transferred the petition to it.
