BJP MLA Raja Singh's wife Usha Bai has approached the High Court pleading it to grant bail to her husband, who is lodged at the Charlapally central prison under the Preventive Detention Act.
The BJP MLA was arrested on August 26 under the PD Act after he posted a video on YouTube allegedly denigrating the Prophet Muhammad. He had earlier been released within a few hours on bail after he was arrested for the same issue. (The PD Act allows the police to arrest someone if they suspect that he is a threat to public order and if he has a track record of that, even if he has not committed a crime yet.)
Usha challenged the orders of the police. In her petition, she told the HC that the orders of the police were against Articles 14 and 21 of the Constitution, and that the State government had issued GO No. 1,651 on August 26 solely to pave way for the arrest of her husband.
She also alleged that the police did not specify the cases filed against her husband, and did not issue any notices to her husband under Section 41 A of the CrPC.
