High Court Stays Amrapali Kata's Telangana Posting

The Telangana High Court today granted an interim stay on the CAT order that had directed that IAS officer Amrapali Kata be allotted to Telangana.

The Telangana High Court today granted an interim stay on the Central Administrative Tribunal's (CAT's) order that had directed that IAS officer Amrapali Kata be allotted to the Telangana cadre.

The bench directed Amrapali's counsel to file a counter-affidavit and posted the matter for further hearing after six weeks.

For context, the Department of Personnel & Training (DoPT) had issued orders in October last year allotting Amrapali to the Andhra Pradesh cadre. Aggrieved, Amrapali approached the CAT, which - relying on a mutual-consent swap arrangement - ordered that she be re-allocated to Telangana by swapping positions with IAS officer Harikiran. The CAT's directive effectively overturned the DoPT's earlier allocation.

The DoPT challenged the CAT order before the High Court, arguing that the swapping formula could not be applied because Harikiran belonged to a reserved category and such a swap would violate reservation/roster norms governing cadre allocation. Taking note of that contention, the court stayed the CAT order pending detailed arguments.

The stay keeps the tribunal's order in abeyance until the High Court disposes of the petition or until the next hearing.

Legal experts and administrative observers say that the case tests the limits of mutual-consent cadre swaps when reservation roster rules are involved. If the High Court upholds the DoPT's objections, it may restrict use of swapping as an administrative remedy in cases where a reserved-category roster position is implicated - a precedent that could affect future cadre allocation disputes.

Kata, who has previously served in Telangana (including in a stint as GHMC Commissioner), was among several officers affected when the DoPT issued re-allocation orders last year. The dispute over her posting has been closely watched by State administrators and has generated extensive media coverage.
